LIVE | BS Yeddyurappa heads to Raj Bhavan, to take oath as CM shortly

Bharatiya Janata Party’s BS Yeddyurappa on Thursday took oath as the Chief Minister of Karnataka, even as his party was short of simple majority. However, Congress and Janata Dal-Secular remain unrelenting and protested strongly.

Karnataka Governor Vajubhai Vala on Wednesday invited Yeddyurappa, the legislative leader of the single largest party, to form the government.

Despite emerging as the single largest party, the BJP fell short of the majority in the Karnataka Assembly elections and the Governor has given 15 days time to Yeddyurappa to prove majority on the floor of Assembly.

However, the Congress, which tied up with the Janata Dal-Secular (JD-S) to keep the BJP out of power cried foul and moved the Supreme Court against the “encounter of Constitution”. In a rare post-midnight hearing, the Supreme Court refused to stay BS Yeddyurappa’s swearing-in as the state chief minister.

#08:15 AM: Who stands where in the number game: The Congress won 78 seats and the JD-S has 37 seats. So the coalition now has 78+37= 116 seats. The magical number required to form a government is 112. So Congress-JD-S coalition has enough numbers to form a stable government. The BJP, which is the single largest party has 104 seats. The party is at least 8 seats short of the majority.

#08:00 AM: The post-midnight drama: Congress filed a petition against Governor's invitation to Yeddyurappa and urged Chief Justice Dipak Misra to hold an urgent hearing. CJI Misra constituted a three-judge bench of Justice AK Sikri, Justice Ashok Bhushan and Justice Gobde to hear the petition. The Congress-JD-S please said, "Court may pass an order declaring order of Governor inviting BS Yeddyurappa to form govt as unconstitutional and quash the same, or, pass direction to Guv to invite alliance of INC & JD(S) which has support of more than 112 MLAs to form gov." However, the apex court refused to stay the swearing-in ceremony of Yeddyurappa but said that it will be subject to outcome of writ petition filed by Congress & JD(S).
