The Delhi Police dropped charges of rape against the four-year-old boy who was booked last year after his classmate was allegedly sexually assaulted in a reputed school in the national capital’s Dwarka area.
The incident had grabbed national headlines in November last year due to the age of the accused and the victim.
The girl’s mother then had claimed that the boy had used his finger and a sharpened pencil to sexually assault her four-year-old daughter. She had also accused that the school management did not take the matter seriously on informing the incident.
The Delhi Police then has charged the boy under POSCO Act, but now have decided to drop the charges against the boy since the Indian Penal Code’s Section 82 states that no act committed by child under age of seven can be considered as an offence.

However, the Delhi Police has booked the principal and coordinator of the school as the class teacher. The three have been booked under section 21 of POSCO Act — not informing authorities about a sexual offence.
