Aadhaar card controversy: SC sets up 9-judge constitutional bench to decide whether privacy is a fundamental right

Five judge bench of the Supreme Court, hearing the Aadhaar Card privacy matter, on Tuesday set up a nine-judge constitutional bench to decide if privacy was a Fundamental Right. 

After the nine-judge bench's decision, the five judge bench will rule on if linking PAN card with Aadhaar violates the privacy of an individual. 

The five judge bench took the decision while hearing the plea filed by a batch of the petitioner, which has challenged Aadhar validity on the ground that collection of biometric data violates right to privacy.

Meanwhile, the government stand on this issue is privacy is a right under common law but not in Indian constitution and is not a fundamental right.
