The Supreme Court has transferred two cases of Bombay High Court to the Supreme Court. The Top Court has fixed the first week of February for further hearing as it observed that it would examine all the documents related to the death of Judge Loya.
Maharashtra government told Supreme Court that a careful and prudent investigation was conducted after the media reports and four judicial officers assured there was no foul play involved. The three-judge bench recorded statements saying Judge Loya died of cardiac arrest.
A three-judge bench of the Supreme Court, headed by Chief Justice of India (CJI) Deepak Misra along with Justice AM Khanwilkar and DY Chandrachud is hearing the case related to the death of Judge BH Loya.
The case will continue to be with the CJI’s bench.
CBI Judge BH Loya allegedly died of a cardiac arrest in Nagpur on December 1, 2014, where he had gone to attend the wedding of a colleague's daughter.
He was hearing the politically sensitive case of Sohrabuddin Sheikh ‘fake police encounter’ in which BJP President Amit Shah was the main accused.
A bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud said an appropriate bench of the Top Court would hear the petitions filed by Congress leader Tehseen Poonawalla and Maharashtra journalist B S Lone.
The Supreme Court had earlier termed as a serious matter the issue of Judge Loya's death and had asked Maharashtra government to file certain documents, including the autopsy report.
“I'm hopeful the decision will be in our favour. I believe justice will be served to Justice Loya. We demand that the case be heard in an independent organisation,” said Bandhuraj Lone, one of the petitioners who filed the plea in the Supreme Court seeking SIT probe in Justice Loya death case.
