Taking exception to the refusal of a government doctor to conduct a medical test of an alleged rapist, a local court has ordered an explanation from the doctor and state medical authorities.

“The learned judge Vivekanand Saran Tripathi, has also ordered to send the copy of the order to Director General Health and Medical services, Lucknow, National and State Commission for Protection of Child Rights, Lucknow,” Assistant Government Counsel Ravinder Singh said.

“Additional District Judge, Mathura, has ordered to appoint another doctor for conducting medical including DNA profile, swab, finger, nail clipping of the rapist since it is not only violation of order of High Court but an attempt to give relief to the accused and to influence the investigation.

He said the judge not only ordered Chief Medical Officer, Mathura, to appoint some other doctor to conduct medical of accused, but also did not grant remand to the accused till his medical was conducted.

According to FIR filed in Vrindavan police station, on February 15, 18-year-old Manoj took a five-year-old girl of his village, falling under Vrindavan police station, to his cattle shed and raped her.

Her parents took the unconscious girl to hospital after being informed by a pedestrian.

According to police Manoj was arrested on February 16, nearly 20 hours after the incident.

“The salient feature of the case is that the learned judge ordered remand only after the medical of the accused was conducted since this medical may prove an added advantage for prosecution,” Singh concluded.
