Nirbhaya Case: Rejected by Indian courts, three convicts now approach ICJ seeking stay on their execution

Three convicts in the Nirbhaya gang-rape and murder case — Akshay Singh, Pawan Gupta and Vinay Sharma — have moved the International Court of Justice (ICJ) seeking a stay on the execution of their death sentence. The move comes after a trial court on March 5 had issued fresh warrants with March 20, 5:30 am, as the date for the execution of the convicts — Mukesh Singh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Singh (31).

On Monday, the Supreme Court rejected a petition filed by Mukesh Kumar seeking to refile curative and mercy petitions. The Supreme Court has ordered dismissed as withdrawn, the petition filed by Mukesh, seeking action against his former lawyer Vrinda Grover.

"The petition is not maintainable," Justice Mishra said and dismissed the petition.

In a plea filed through Advocate ML Sharma, Mukesh Singh claimed last week that the limitation period to file a curative petition was three years from the date of dismissal of the review plea.

Mukesh Singh's review petition was dismissed by the Supreme Court in July 2018. Singh asked the court to "restore" the rights available to him, and allow him to file curative and mercy petitions till July 2021.
