The Allahabad High Court on Thursday slammed the Yogi Adityanath government over failure to arrest the accused BJP MLA Kuldeep Singh Sengar.
The court also added that it will pronounce its order on the case at 2 pm on Friday.
While at the hearing on Thursday, it asked the counsel representing the Uttar Pradesh government why the Bhartiya Janata Party (BJP) MLA, who was accused of raping the minor girl, had not yet been arrested.
Advocate General Raghvendra Singh, who was representing the state government, told the court that there was no enough evidence against Kuldeep Senger as per the investigation team.
The UP Police on Thursday had filed an FIR against Sengar, charging him under the POSCO Act and Indian Penal Code (IPC) (including Section 376 for rape), confirmed a senior police officer.
Sengar, on Wednesday night, asked the Lucknow police to call him if there was an arrest warrant against him. Sengar said, “When there is an arrest warrant, call me.”
Sengar reached the Lucknow SSP’s office at around 11:40 pm at night and told reporters that he was being framed. He said, “I just came here to prove that I have done no wrong and would be here anytime the police wants me.”
Sengar reached the SSP with office with nearly two dozen supporters in tow. When confronted by the media, the MLA said that he had come to enquire whether his name had appeared in any of the First Information Reports (FIRs).
On the way back, Sengar and his henchmen got into a scuffle with the media reporters.

However, OP Singh, DGP of UP, cleared that no one was backing up the BJP MLA. He said, “Nobody is defending him(#KuldeepSinghSengar), all we are saying is that we have to hear both sides. Now case has been given to CBI, they will decide on arrest.”
While on the other hand, BJP MLA from Bairia, Surender Singh, said that the minor had filed a false case against Sengar. Singh said, “Narco test should be done of Kuldeep Singh Sengar &complainant, truth will be out then. If MLA found guilty punish him, but I have heard this same girl had filed a false rape case against a man some years back,man had to spend 6 months in jail.”
The Unnao rape case came into light when the survivor attempted suicide outside UP Chief Minister Yogi Adityanath’s Lucknow residence on Sunday demanding justice.
The victim alleged that Sengar and his accomplices had gang-raped her.
Sengar and his henchmen are also custodial in the death of the victim’s father. A Special investigation Team (SIT) formed by the UP Police to probe the alleged rape and the death of the victim’s father reportedly found serious lapses by police and doctors in Unnao.
