Delhi HC issues notice to police on Gopal Ansal's plea to quash FIR

New Delhi [India], July 8 (ANI): The Delhi High Court on Monday iued a notice to police on a plea moved by real etate baron Gopal Anal, convicted in the Uphaar fire tragedy cae, for quahing an FIR lodged againt him in a cheating cae.
The FIR ha been lodged on a complaint filed by a buyer of land in a project developed by Anal Buildwell Limited. Jutice Amit Mahajan iued notice to Delhi Police and ought a tatu report. The matter ha been lited for hearing on September 10.
The High Court ha alo directed the tate not to take coercive tep againt the petitioner till the next date of hearing. The bench ha alo iued a notice to the complainant in the matter upon the filing of the amended memo of the partie.
Gopal Anal ha filed a petition eeking quahing of the FIR regitered on February 11, 2025, at Police Station Barakhamba Road for the offence under Section 420, 406, 120B of the Indian Penal Code.
The aid FIR wa regitered on a complaint given by Manoj Anand, alleging that he had paid a um of R 3,56,000 regarding the purchae of certain land in a project being developed by the accued company, Anal Buildwell Limited.
Gopal Anal i tated to be the director of the accued company at the relevant time. It i alleged that no property wa ever handed over to the complainant, Anand, the High Court noted.
Advocate Suhil Kumar Gupta, counel for Gopal Anal, ubmitted that the project could not ee the light of day ince the Jaipur Development Authority did not give permiion to convert the tatu of the land.
He ubmitted that variou letter were written to the complainant for a refund of money. However, no repone wa received, and the complaint ha now belatedly been made after almot two decade.
Upon learning thi fact, the High Court alo tated, Prima facie, thi Court ha been unable to figure out why uch an FIR after two decade wa regitered by the police authoritie.
It wa alo ubmitted that the accued company, even otherwie, had alway been willing to refund the entire money with reaonable interet to the complainant.
Anal counel further ubmitted that to how hi bona fide, a um of R 10,00,000 hall be depoited by Anand with the Regitrar General of thi court within a period of four week.
