Allahabad High Court stays allotment of 1,000 flats in Supertech Czar suites in Greater Noida
Supertech Went On To Construct Total Of 1904 Flats And Applied For A Revised Sanction Afterwards With A View To Getting Theillegal Constructions Legalised
Giving a big blow to realty player Supertech, the Allahabad High Court on Wednesday stayed allotment of more than 1,000 flats in Supertech CzarSuites luxury apartments at Greater Noida after allegations that proper sanction was not obtained for their construction.
The petitioners moved the court alleging that the housing project, coming up in Sector Omnicon 1 of Greater Noida, was launched in 2007 with a sanction for only 844 flats from Greater Noida Authority. However, according to the petitioners, the builders went on to construct a total of 1904 flats and applied for a revised sanction afterwards with a view to getting the"illegal" constructions legalised.
Fixing February 8 as the next date of hearing in the matter, the court directed the Greater Noida Authority not to issue the certificate of completion to the builder and take appropriate action in accordance with law.
The court also directed that none of the buyers of the flats in question should be given possession. The court also asked the Greater Noida Authority to ensure the presence of one of its officers on the next date of the hearing to assist the court with facts relating to the case.
A Division Bench comprising Chief Justice D B Bhosale and Justice Yashwant Verma passed the order on a petition filed by VK Sharma and eight others who had invested in the housing project.
The Czar suites are completed and procession for the same have started and it is the 2, 3 & 4 super luxury bedrooms and penthouses with servants' quarter. Czar Suites are being developed in 20 acres of land.
