Triple talaq unconstitutional, violates rights of Muslim women, observes Allahabad HC
While Hearing Two Separate Pleas On The Issue, The High Court Said That The Practice Of Triple Talaq Also Violates The Rights Of Muslim Women.
Terming the practice of 'triple talaq' as unconstitutional, the Allahabad high court on Thursday said that no personal law board is above the Constitution.
While hearing a plea filed by some Muslim women on the issue, the high court observed that the practice also violates the rights of Muslim women.
We respect high court's verdict but we've constitutional right to appeal against it we are not satisfied, ANI quoted Muslim cleric Khalid Rasheed Firangi Mahali.
The high court said the triple talaq practice – sanctioned under Muslim personal law that governs marriage, property and divorce – violats the rights of Muslim women.
The court said even the holy Quran does not have such a provision.
The practice has been challenged in the Supreme Court as well. The Centre has told the apex court that it is against gender justice, equality and the Constitution.
The All India Muslim Personal Law Board (AIMPLB) has defended the practice saying it is better to divorce a woman than kill her. The rights bestowed by religion can’t be questioned in a court of law, it has said.
