Aadhaar not mandatory for NRI's and residents of J&K, Meghalaya, Assam
The Govt, Under The New Finance Act 2017, Has Made It Mandatory For Taxpayers To Provide Aadhaar Or Enrolment ID Of Their Aadhaar Application Form For Filing Income Tax Return And Obtaining Pain Cards.
The ministry of finance issuing a notification has exempted residents of Assam, Jammu and Kashmir, Meghalaya, and older people above 80 years of age from mandatory quoting of Aadhaar to obtain PAN cards and file tax returns.
The govt, under the new finance act 2017, has made it mandatory for taxpayers to provide Aadhaar or enrolment ID of their Aadhaar application form for filing income tax return and obtaining pain cards.
The notification of finance ministry came at a time when a case challenging the order of finance ministry to make Aadhaar mandatory is pending in Supreme Court.
The apex court has reserved its verdict on a batch of pleas challenging the constitutional validity of a provision in the Income Tax Act to make Aadhaar mandatory.

The notification says, “an individual who does not possess the Aadhaar number or the enrolment ID” and residing in Meghalaya, Jammu and Kashmir and Assam would be exempted to quote the Aadhaar card for filing tax returns.
The exemption is also for old people above 80 years and NRI.
Aadhaar has been made mandatory for applying for PAN with effect from July 1, 201, and till now 1.18 crore Aadhaar with PAN database.
